This End-User License Agreement ("EULA") is a legal agreement between you
(either an individual or a single legal entity) and the European Space
Research and Technology Centre ESTEC (ESA), which covers your use of
JHelioviewer and related software components ("Software Product").

If you do not agree to the terms of this EULA, then do not download,
install or use the Software Product. By explicitly accepting this EULA
you are acknowledging and agreeing to be bound by the following terms:


1. Disclaimer

This Software Product and services are provided "as is". Neither ESA nor
any other party involved in creating, producing or delivering this
Software Product shall be liable for any direct, incidental,
consequential, indirect or punitive damages arising out of users' access
to, or use of, the Software Product. This Software Product does not
guarantee the accuracy or availability of information provided by
external sources and accepts no responsibility or liability for any
consequences related to the use of such data.

Though ESA uses the best technical standards to control its software,
this Software Product may inadvertently include technical inaccuracies or
other errors. Please note that users use this Software Product at their
own risk. ESA does not warrant that the functional aspects of this
Software Product will be uninterrupted or error free or that this
Software Product, or the related servers are free of viruses or other
harmful components.

To ensure users get the best possible quality of the service, ESA
reserves the right to interrupt the service for maintenance or need to
update the system, without informing users in advance.


2. Access and availability of service and links

This Software Product may contain links and references to third-party
services. These are provided for the convenience and interest of users
and on the part of ESA this implies neither responsibility for, nor
approval of, information provided by these services. ESA makes no
warranty, either express or implied, as to the accuracy, availability or
content of this information. ESA has not tested any software located on
other sites and does not make any representation as to the quality,
safety, reliability or suitability of such software. 


3. Personal data privacy

By using this ESA Software Product, certain information about users, such
as internet protocol (IP) addresses, navigation through the Software
Product, software used and time spent, as well as other similar
information, will be stored on servers. These will not specifically
identify users and the information will be used internally for software
analysis only. If users provide unique identifying information, this
information will be used for statistical purposes only and will not be
published or made available for general access. ESA does not sell or rent
its users' names, addresses, email addresses or other personal
information. 

Among the types of information that this Software Product and its
services collect, by itself or through third parties, there are: Usage
data, data requests, installed hardware and software and performance
metrics. Other data collected may be described by dedicated explanation
text contextually with the data collection.


4. Use of IP address

The IP address is a number that is automatically given to your computer
when you are surfing on the internet. Servers automatically identify your
computer through its IP number. ESA uses IP addresses in order to carry
out statistics, however, as IP addresses and personal identification are
not linked to each other users remains anonymous. 


5. Methods of processing

ESA processes the data of users in a proper manner and shall take
appropriate security measures to prevent unauthorized access, disclosure,
modification, or unauthorized destruction of the data. The data
processing is carried out using computers and/or IT enabled tools,
following organizational procedures and modes strictly related to the
purposes indicated. In addition to ESA, in some cases, the data may be
accessible to certain types of persons in charge, involved with the
operation of the site (administration, legal, system administration) or
external parties (such as third party technical service providers, mail
carriers, hosting providers, IT companies, communications agencies)
appointed, if necessary, as data processors by the owner.


6. Legal action

The user's data may be used for legal purposes by ESA, in court or in the
stages leading to possible legal action arising from improper use of this
Software Product or the related services. The user declares to be aware
that ESA may be required to reveal data upon request of public
authorities.


7. Copyright

All trademarks, nominal or figurative, and all other marks, trade names,
service marks, word marks, illustrations, images, or logos that appear
are, and remain, the exclusive property of the respective owner or its
licensors and are protected by the laws in force on trademarks and by
related international treaties.


8. Legal information

Notice to European Users: this privacy statement has been prepared in
fulfillment of the obligations under Art. 10 of EC Directive n. 95/46/EC.

This privacy policy relates solely to this Software Product.


9. General

This EULA is the entire agreement between ESA and you, and supersedes any
other communications or advertising with respect to the Software Product;
this EULA may be modified only by written agreement signed by authorized
representatives of you and ESA. If any provision of this EULA is held
invalid, the remainder of this EULA shall continue in full force and
effect. All rights not expressly granted in this agreement are retained
by ESA.
